Agreement to Terms

By accessing or using RE:Writeoff ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. We reserve the right to modify these terms at any time; continued use after changes constitutes acceptance.

Description of Service

RE:Writeoff is a software tool that helps real estate investors track and document property management activities for tax purposes. The Service connects to your email and other data sources to automatically identify, classify, and log activities relevant to real estate tax deductions.

Not Tax, Legal, or Financial Advice

RE:Writeoff is a documentation tool, not a tax advisor. The Service assists with activity tracking and record-keeping, but does not provide tax advice, legal advice, or financial guidance. Classifications and time estimates generated by the Service are approximations based on AI analysis and may not be accurate.

You are solely responsible for verifying the accuracy of any information generated by the Service before using it for tax filings or other purposes. We strongly recommend consulting a qualified tax professional for advice specific to your situation.

RE:Writeoff does not guarantee that activities classified by the Service will qualify as deductible under IRS rules. Tax law is complex and fact-specific; what the Service identifies as a potential deduction may not apply to your circumstances.

Account Responsibilities

• You must provide accurate information when creating your account.
• You are responsible for maintaining the security of your account credentials.
• You must be at least 18 years old to use the Service.
• You are responsible for all activity under your account.

Data Access and Permissions

The Service requires access to your Google account data (email, calendar, contacts, and/or drive) to function. By connecting your Google account, you authorize us to access this data as described in our Privacy Policy.

You can revoke access at any time by disconnecting your account within the Service or through your Google Account settings. Revoking access will stop further data collection but previously classified activities will remain until you delete your account.

Acceptable Use

You agree not to:

• Use the Service for any illegal purpose or to facilitate tax fraud.
• Attempt to reverse-engineer, decompile, or extract source code from the Service.
• Interfere with or disrupt the Service or its infrastructure.
• Share your account credentials with others or allow unauthorized access to your account.
• Use the Service to process data you do not have the right to access.

Intellectual Property

The Service, including its design, code, algorithms, and branding, is the property of RE:Writeoff and is protected by applicable intellectual property laws. You retain ownership of your data; we claim no ownership of your emails, documents, or other personal content.

We grant you a limited, non-exclusive, non-transferable license to use the Service for its intended purpose during your active subscription.

Service Availability

We strive to keep the Service available 24/7 but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any loss or damage resulting from Service unavailability.

Limitation of Liability

To the maximum extent permitted by law, RE:Writeoff and its officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, revenue, or anticipated savings.
• Tax penalties, fines, or additional tax liability arising from reliance on Service-generated classifications.
• Data loss or corruption.
• Any damages resulting from unauthorized access to your account.

Our total liability for any claim arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that AI-generated classifications are accurate, complete, or suitable for any specific tax situation.

Termination

You may terminate your account at any time. We may suspend or terminate your access to the Service at our discretion if you violate these Terms. Upon termination, your right to use the Service ceases immediately. Data deletion follows the timeline described in our Privacy Policy.

Governing Law

These Terms are governed by the laws of the United States, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved in the courts of the United States.
